本法第三十二条、第三十四条、第四十六条、第五十六条规定给予行政拘留处罚，其他法律、行政法规同时规定给予罚款、没收违法所得、没收非法财物等其他行政处罚的行为，由相关主管部门依照相应规定处罚；需要给予行政拘留处罚的，由公安机关依照本法规定处理。
